1. Definitions
1.1 App: this application for IOS and Android mobile devices aimed to inform Users about Events of all over the World.
1.2 Event: event organized by Deus or to which Deus participates, for example as sponsor or partner.
1.3 Deus: DEM Europe B.V. and any other company of the group Deus Ex Machina Motor Cycles Pty Ltd.
1.4 Personal Data: any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
1.5 Privacy Policy: this privacy information notice.
1.6 Processing: any operation or set of operations which is performed on Personal Data or on sets of Personal Data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

1.8 Users: App users.

2. Data Controller DEM Europe B.V
The Data Controller of the Processing described in this Privacy Policy is DEM Europe B.V., with registered office in Startbaan 8, 1185XR Amstelveen, Netherlands, Company register No. 858006236 (“DEM Europe”).
Any User’s request related to the Processing carried out by DEM Europe concerning the Personal Data (also in relation to the exercise of the rights according to section 9 below) shall be addressed to DEM Europe by mail service at the registered office, or by e-mail to the following address privacy.eu@deuscustoms.com.

3. Processing purposes and legal basis
DEM Europe collects and processes Users’ Personal Data for the following purposes:
a) Downloading and using the App.
➢ The collection of Personal Data for the purpose indicated in the above letter a) is necessary for using the App and refusing such collection will impede the User to download and use the App. The legal basis of this Processing is the free, specific, informed and unambiguous consent of the User, given through a statement or by a clear affirmative action on the App (e.g. flag). The withdrawn of the consent can be exercised by the User at any moment, following the instruction indicated at section 9 letter a) of this Privacy Policy.
b) Geolocation
➢ The collection of Personal Data for the purpose indicated in the above letter b) is voluntary for using the App and refusing such collection will impede the User to use the geolocation services in order to easily find the Event around his/her location. The legal basis of this Processing is the free, specific, informed and unambiguous consent of the User, given following the instructions on your mobile device in order to enable the sharing of this information. The withdrawn of the consent indicated at section 9 letter a) of this Privacy Policy can be exercised by the User at any moment, following the instructions on his/her mobile device in order to change the settings and deny the sharing of location data.
c) Push notification
➢ The collection of Personal data for the purpose indicated in the above letter c) is voluntary for using the App and refusing such collection will impede the User to receive push notifications on his/her mobile device containing information or updates about an Event. The legal basis of this Processing is the free, specific, informed and unambiguous consent of the User, given following the instructions on your mobile device in order to enable the receipt of this notification. The withdrawn of the consent indicated at section 9 letter a) of this Privacy Policy can be exercised by the User at any moment, following the instructions on his/her mobile device in order to change the settings and deny the receipt of push notification.

4. Means of data collection
a) Personal Data entered on this App by the Users.
b) Personal data automatically provided by the Users’ mobile device.

DEM Europe collects Personal Data with the following procedures:
a) Personal Data entered on this App by the Users: these are Personal Data submitted by the Users, by way of example and not limited to, in order to download the App;
b) Personal Data automatically provided by the Users’ mobile device: these are Personal Data automatically provided by the Users’ mobile device, by way of example, through the sharing of location data.
5. Possible categories of recipients of Personal Data
Employees, collaborators, third-party providers of IT, companies of the group of which DEM Europe belongs to.
Personal Data are processed by DEM Europe and/or by third parties, selected on the basis of their reliability and competence, and to which the Personal Data can be disclosed in so far as it is necessary or advisable, as long as located within the European Union. In particular, DEM Europe informs the Users that Personal Data can be processed by, an/or communicated to: a) employees and/or agents of DEM Europe;
b) third party that provide services necessary to ensure the operation of the App (for example, companies involved in the hosting services);
c) third parties that provide analysis services regarding the navigation data of the App;
d) subject to voluntary consent, third parties that provide automatic services for sending out push notification;
e) other companies belonging to DEM Europe’s group of companies.

6. Personal Data retention period
The App does not store any Personal data.
The App does not store any Personal Data regarding the using of the App, the location shared by the Users’ mobile device and the push notification accepted by the Users, for the purposes indicated at previous section 3 letters a), b) and c).

7. Possible transfer of Personal Data extra EU
Personal Data collected by DEM Europe for the purposes indicated in the section 3 above of this Privacy Policy, are transferred to DEM Europe, under the following conditions, in accordance with artt. 44 ss. of the Regulation, to the company Deus Ex Machina Motor Cycles Pty Ltd, with registered office in Australia, Level 1, 98-104 Parramatta Road, 2050 Camperdown, New South Wales, parent company of DEM Europe, by virtue of appropriate guarantees to assure the protection of Personal Data. More information regarding said appropriate guarantees may be requested to DEM Europe.

8. User’s rights
Withdrawal of consent, access to Personal Data, rectification or integration of Personal Data, erasure of Personal Data, restriction of Processing, Personal Data portability, data breach, filing a complaint with the competent supervisory authority.
Pursuant to the Regulation, every User has the right to:
a) with reference to the Processing at above section 3 letters a), b) and c), withdraw his or her consent at any time, and the withdrawal of consent shall not affect the lawfulness of the previous Processing (cf. Regulation art. 7);
b) obtain access to Personal Data and to the information on the Processing and any possible copies in electronic form, unless otherwise specifically requested by the User (cf. Regulation art. 15);
c) ask the rectification and/or integration of Personal Data, without undue delay (cf. Regulation art. 16);
d) where specific grounds apply (for example unlawful data process, withdraw of consent, absence of purposes for Processing), ask the erasure of Personal Data, without undue delay (cf. Regulation art. 17);
e) where specific circumstances apply (for example the inaccuracy of Personal Data, Processing is unlawful, exercise of legal claims), ask the restriction of the Processing (Regulation art. 18);
f) in case of Processing through automated means, receive Personal Data in a readable format, with the purpose of transmitting those data to a third party, or where technically feasible, ask DEM Europe the direct transmission of Personal Data from DEM Europe to such third party (so-called right to Personal Data portability - cf. Regulation art. 20);
g) be informed by DEM Europe without undue delay of possible Personal Data breach or unauthorized access by third parties (c.d. data breach - cf. Regulation art. 34); h) filing a complaint with a supervisory authority, in the EU Member State of his or her habitual residence, place of work or place of the alleged infringement (cf.
